These Terms & Conditions govern your access to and use of Vittorix’s website, AI receptionist services and related services.
By using Vittorix or subscribing to a Vittorix service, you agree to these Terms & Conditions.
1. About Vittorix
Vittorix provides AI-powered receptionist services designed to help businesses manage incoming calls, customer enquiries, lead capture, appointment scheduling, call transfers and related customer communications.
Vittorix is based in Sydney, New South Wales, Australia.
2. Acceptance of Terms
By accessing our website, starting a free trial, purchasing a subscription or otherwise using Vittorix services, you acknowledge that you have read, understood and agree to these Terms & Conditions.
If you do not agree to these Terms, you must not use Vittorix services.
If you are accepting these Terms on behalf of a business, you confirm that you have authority to bind that business to these Terms.
3. Vittorix Services
Depending on your plan and individual configuration, Vittorix services may include:
- AI-powered call answering
- Customer enquiry handling
- Lead capture and qualification
- Emergency or priority enquiry identification
- Appointment scheduling
- Calendar integration
- Call transfers
- Customer SMS notifications
- Business notifications
- Call recordings, where enabled
- Call transcripts
- AI-generated call summaries
- Customer communication workflows
- Access to a Vittorix client dashboard
- Other agreed receptionist functionality
Features may vary depending on the customer’s plan, business requirements, configuration and third-party services.
Not every feature is available or included in every plan.
4. Live Demonstrations
Vittorix may provide live demonstrations that allow prospective customers to experience an example Vittorix AI receptionist.
Demonstrations are provided for evaluation and informational purposes only.
A demonstration may use a sample business configuration and does not necessarily represent the exact configuration, features or performance that will apply to a customer’s individual Vittorix service.
Using a demonstration does not create an obligation to purchase Vittorix.
5. 7-Day Free Trial
Vittorix may offer eligible new customers a 7-day free trial.
Unless otherwise agreed in writing, the free trial:
- Runs for 7 consecutive days from activation
- Includes up to 25 calls during the trial period
- Is limited to one free trial per business
- Does not require payment solely to commence the trial
- Does not automatically convert into a paid subscription
- Does not include access to the Vittorix client dashboard
The free trial is designed to allow a business to evaluate the Vittorix AI receptionist service.
Certain features available to paying customers may be unavailable or restricted during the trial.
If the customer reaches the 25-call trial allowance before the end of the 7-day period, Vittorix may pause the trial service unless otherwise agreed.
At the end of the trial, the customer may choose to subscribe to an available paid plan.
If the customer does not subscribe, the trial service may be deactivated.
Access to the Vittorix client dashboard becomes available only with an eligible paid subscription.
Vittorix may refuse, withdraw or discontinue a free trial where reasonably necessary to prevent misuse, duplicate trials, fraud or abuse.
6. Subscription Plans
Unless otherwise agreed in writing, Vittorix currently offers the following standard paid plans.
Starter Plan
$299 AUD per month
Includes up to 100 calls per billing month.
After the included 100-call allowance has been exceeded, calls received for the remainder of that billing period are charged based on their duration at:
$0.25 AUD per additional minute.
The per-minute additional usage charge applies to the usage occurring on calls after the first 100 calls in that billing period.
Growth Plan
$599 AUD per month
Includes up to 300 calls per billing month.
After the included 300-call allowance has been exceeded, calls received for the remainder of that billing period are charged based on their duration at:
$0.20 AUD per additional minute.
The per-minute additional usage charge applies to the usage occurring on calls after the first 300 calls in that billing period.
Custom Plan
Businesses requiring higher call volumes, specialised workflows or other requirements may contact Vittorix for custom pricing.
Custom pricing, allowances, features and conditions will be agreed separately with the customer.
All prices are in Australian dollars unless otherwise stated.
7. How Call Usage Is Calculated
For the Starter and Growth plans, the included usage allowance is measured by the number of calls handled by the Vittorix service during each billing period.
For clarity:
- Starter includes the first 100 calls in the billing period.
- Growth includes the first 300 calls in the billing period.
- Calls within the included allowance do not incur the additional per-minute usage charge.
- Once the applicable call allowance has been exceeded, subsequent calls during that billing period are subject to the applicable per-minute additional usage rate.
- Usage resets at the beginning of each new billing period.
Call and usage records generated by Vittorix’s systems and service providers may be used to calculate usage, subject to correction where a genuine billing error is identified.
8. Additional Usage Charges
Customers are responsible for additional usage charges incurred after exceeding the call allowance included in their plan.
For the Starter Plan, additional usage is charged at:
$0.25 AUD per minute after 100 calls.
For the Growth Plan, additional usage is charged at:
$0.20 AUD per minute after 300 calls.
Additional usage charges may be billed separately or added to the customer’s next applicable invoice or billing transaction.
Vittorix will not intentionally charge additional usage that did not occur.
Customers who believe a usage charge is incorrect should contact Vittorix so the matter can be investigated.
9. Billing and Payment
Paid subscriptions are billed in advance on a recurring monthly basis unless otherwise agreed.
By purchasing a paid subscription, the customer authorises Vittorix and its payment service provider to charge the applicable subscription fees and any properly incurred additional usage charges to the customer’s selected payment method.
Customers are responsible for maintaining valid and current billing information.
If a payment fails, Vittorix may notify the customer and provide a reasonable opportunity to update their payment details.
If payment remains outstanding, Vittorix may suspend or restrict the affected service until payment is received.
10. No Lock-In Contract and Cancellation
Unless otherwise agreed for a Custom Plan or separate agreement, Starter and Growth subscriptions operate on a month-to-month basis.
There is no minimum fixed subscription term.
Customers may cancel their subscription before the next renewal date to prevent the next monthly renewal.
Cancellation does not ordinarily result in a refund for the unused portion of a billing period that has already commenced, except where required by Australian Consumer Law or another applicable law.
The customer may continue to receive the paid service until the end of the period for which they have already paid, unless otherwise agreed or the service is terminated for a permitted reason under these Terms.
Cancellation does not remove responsibility for legitimate charges incurred before cancellation, including applicable additional usage charges.
11. Pricing Changes
Vittorix may change its subscription pricing or usage rates from time to time.
Where a pricing change affects an existing paid customer, Vittorix will provide reasonable notice before the new pricing takes effect.
A customer who does not wish to continue at the new price may cancel their subscription before the new pricing becomes applicable to their subscription.
Price changes do not affect rights that cannot be excluded under applicable law.
12. Setup and Configuration
Vittorix receptionist services may be configured according to information and instructions provided by the customer.
Customers are responsible for providing accurate and sufficiently complete information about their business, including where relevant:
- Business name
- Contact details
- Services
- Business hours
- Appointment availability
- Service areas
- Emergency procedures
- Call-transfer instructions
- Calendar information
- Customer communication requirements
- Other information required to configure the receptionist
Vittorix is not responsible for errors resulting directly from inaccurate, incomplete or outdated information supplied by the customer.
Customers should notify Vittorix when material business information or instructions change.
13. Customer Responsibilities
Customers agree to:
- Use Vittorix lawfully
- Provide accurate business information
- Keep relevant information reasonably current
- Maintain appropriate access to systems connected to Vittorix
- Protect account credentials
- Use the service for legitimate business purposes
- Comply with applicable privacy, telecommunications and consumer laws
- Obtain or provide legally required notifications, permissions or consents
- Notify Vittorix of material configuration changes
- Review important business information where appropriate
Customers must not use Vittorix for fraudulent, unlawful, abusive or deceptive activities.
14. Call Recording and AI Disclosure
Vittorix may provide call-recording, transcription and AI-processing functionality.
Where required, appropriate notification may be provided to callers that a call may be recorded or processed.
Customers are responsible for ensuring their use and configuration of Vittorix complies with laws applicable to their business, location and callers, including requirements relating to call recording, privacy and consent.
Vittorix may assist with technical configuration but does not provide legal advice regarding a customer’s individual recording or disclosure obligations.
15. Artificial Intelligence
Vittorix uses artificial intelligence and automated systems.
AI systems can make mistakes.
Responses, summaries, classifications, transcripts, appointment information and other AI-generated outputs may occasionally be inaccurate, incomplete or misunderstood.
Vittorix does not guarantee that every conversation will be interpreted perfectly or that every AI-generated response will be error-free.
Customers remain responsible for determining whether human review or confirmation is appropriate for important business decisions or information.
16. Appointments and Calendar Bookings
Where appointment-booking functionality is enabled, Vittorix may interact with calendars or scheduling systems configured by the customer.
Appointment availability depends on information available to the system at the time of the request.
Vittorix does not guarantee that every booking request will be completed successfully.
Technical issues, calendar changes, third-party outages, incorrect configuration or other circumstances may affect bookings.
Customers remain responsible for managing their business calendar and honouring appointments accepted through their configured systems.
17. Call Transfers
Where call-transfer functionality is enabled, Vittorix may attempt to transfer calls to numbers specified by the customer.
Vittorix does not guarantee that a transferred call will be answered or successfully connected.
Transfers may fail because of network conditions, unanswered calls, voicemail, telecommunications providers or other circumstances outside Vittorix’s reasonable control.
18. Third-Party Services
Vittorix relies on third-party technology and service providers to deliver parts of its services.
These may include providers of:
- Telecommunications
- Artificial intelligence
- Voice processing
- Speech recognition and generation
- Calendar services
- Cloud infrastructure
- Data storage
- Workflow automation
- Email and messaging
- Website services
- Payment processing
The availability or performance of third-party services may affect Vittorix.
Vittorix is not responsible for failures caused solely by third-party services outside Vittorix’s reasonable control, subject to rights and remedies that cannot legally be excluded.
19. Service Availability
Vittorix aims to provide a reliable service but does not guarantee uninterrupted or error-free availability.
Service may occasionally be affected by:
- Maintenance
- Updates
- Telecommunications outages
- Internet disruptions
- Third-party provider outages
- System failures
- Events outside Vittorix’s reasonable control
Where reasonably practicable, Vittorix will work to restore affected services.
20. Client Dashboard
Eligible paid customers may receive access to a Vittorix client dashboard.
Dashboard functionality may include access to information such as leads, calls, enquiries, summaries, appointments or other service information depending on the customer’s configuration.
Dashboard access is not included during the 7-day free trial.
Dashboard access may be modified as the Vittorix platform develops.
Customers are responsible for maintaining the confidentiality of their dashboard login credentials and for activity occurring through their authorised account access.
21. Privacy and Customer Data
Vittorix’s handling of personal information is also governed by the Vittorix Privacy Policy.
Customers using Vittorix to interact with their own customers or callers may have separate obligations under applicable privacy laws.
Customers should ensure that their own privacy policies, notices and business practices appropriately disclose their use of service providers and technologies such as Vittorix where required.
22. Intellectual Property
Vittorix and its licensors retain ownership of Vittorix’s:
- Brand
- Name
- Logos
- Website content
- Software
- Designs
- Systems
- Documentation
- Proprietary technology
- Other intellectual property
A customer’s subscription gives the customer a limited right to use the Vittorix service for their business during the applicable subscription period.
It does not transfer ownership of Vittorix technology or intellectual property to the customer.
Customers retain ownership of their own business information and materials, subject to the permissions reasonably required for Vittorix to provide the service.
23. Acceptable Use
Customers must not use Vittorix to:
- Violate applicable law
- Commit fraud
- Harass or threaten others
- Impersonate another business without authority
- Distribute unlawful content
- Interfere with Vittorix systems
- Attempt unauthorised access
- Reverse engineer Vittorix technology except where legally permitted
- Deliberately misuse or abuse the service
Vittorix may take reasonable action to prevent misuse of its services.
24. Suspension and Termination
Vittorix may suspend or terminate access where reasonably necessary because of:
- Material non-payment
- Fraud
- Illegal activity
- Serious misuse of the service
- Security threats
- Material breach of these Terms
Where appropriate in the circumstances, Vittorix may provide notice and a reasonable opportunity to remedy the issue before suspension or termination.
Immediate action may be taken where reasonably necessary to address fraud, illegal conduct, security risks or serious misuse.
Nothing in this section limits rights available under Australian Consumer Law or other applicable law.
25. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where a guarantee, condition or warranty is implied by law and cannot legally be excluded, these Terms operate subject to that guarantee, condition or warranty.
Information about Australian consumer rights is available from the Australian Competition and Consumer Commission (ACCC).
26. Limitation of Liability
To the maximum extent permitted by law, Vittorix is not liable for indirect, incidental, special or consequential loss arising from use of the service
To the extent permitted by law, Vittorix’s aggregate liability arising from the affected paid services will not exceed the fees paid by the customer to Vittorix for those affected services during the three months immediately preceding the event giving rise to the claim.
These limitations do not apply to the extent that liability cannot lawfully be excluded or limited, including applicable rights under Australian Consumer Law.
27. Changes to These Terms
Vittorix may update these Terms from time to time to reflect changes to the service, business operations or applicable law.
The latest version will be published on the Vittorix website.
Where a material change significantly affects an existing customer’s paid service or rights, Vittorix will provide reasonable notice where appropriate.
28. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Subject to any rights that cannot legally be restricted, disputes relating to these Terms will be subject to the jurisdiction of the courts of New South Wales.
